How Barack Obama and Hillary Clinton are Murdering the American Justice System

The Washington rumor mill (at least the conservative side) is buzzing that the FBI is close to competing its investigation on Hillary Clinton. This investigation concerns not just her email server, but the cover-up, and the financial dealings of the Clinton Foundation and how it may have influenced Hillary’s actions while she secretary of state. It appears that the FBI will submit their criminal case report to main Justice before much longer.

If you look at what has been reported in the press, there can be little doubt that Mrs. Clinton grossly abused her position at the expense of national security with her private email server. Think of it: For four years, she handled all of her official communications as the top diplomat in the land as if she were operating a blog. Thousands of emails have been uncovered over the past months by a State Department that had to be dragged kicking and screaming into doing the search by a federal judge enforcing a lawsuit brought by organizations trying to force compliance with lawful Freedom of Information requests. This is a State Department that was corrupted by Mrs. Clinton. Now we have thousands of documents that were classified in nature, including confidential, secret, top secret and even higher.

When I was a DEA agent stationed at the US Embassy in Bangkok for three years and five years at the US Consulate in Milan, I handled classified documents daily. Knowing the system, it leaves me flabbergasted that she did this for four years, and nobody in the administration called her on it.

When you compare what Mrs. Clinton did with the charges brought against General David Petraeus – to which he pleaded guilty – it comes down to this: Is justice still alive in America, or do we have one system for ordinary people and those not in favor and another system for the rich and powerful?

Hillary and ObamaThis is the decision coming soon to the desk of Attorney General Loretta Lynch as delivered in the form of a criminal case report delivered by FBI director James Comey. The FBI director is known as a straight shooter and a man of absolute integrity. If he recommends prosecution, that drops it in the lap of Lynch, whom I must say was respected as US Attorney in the Eastern District of New York. She is not Eric Holder, who surely would have buried this case from the outset. Yet, Lynch will have to confer with President Obama on this no doubt before acting.

What will Obama say to her? In professional or ethical terms, he should simply tell her to follow the evidence and do her duty as she sees fit. In realistic and political terms, that is something else. Can Hillary take Obama down with her if he allows an indictment to go forward? Can she say that Obama knew about her private server all along-as he surely must have? Can she spill the beans on what Obama did and said on the night of the Benghazi attack? There are so many considerations out there.

On the other hand, if the FBI comes to Lynch with a compelling case, and it is rejected, there will be hell to pay. I expect that Comey would hand in his resignation (as well as others in the FBI). I expect we will see a flood of leaks about what the investigators uncovered. It might be akin to the Saturday Night Massacre during Watergate.

We are going to learn a lot about our system of justice in America and its current condition in the coming weeks or months. It is a system I have believed in all my life. If Mrs. Clinton is charged, she is entitled to a fair trial, as is everyone else. I just hope that the phrase “equal justice under the law” has not become just a phrase with no meaning.
