Are y’all getting ready? There is a storm brewing on the “gay rights” or more accurately, the “gay fascism” front. With the Boy Scouts of America’s (BSA) recent decision to allow homosexual men to become troop leaders, churches that house BSA troops should be ready for the coming lawsuits.
At least that is the fear of many BSA supporters who oppose the change in BSA policy that allows gay troop leaders.
But opponents of a BSA policy change say church-based troops that reject gay adult leaders could face legal risks, especially after the recent Supreme Court ruling that same-sex marriage is legal nationwide.
“What they’re not taking into account is the new frontier that we’re on, where judges are being social change agents,” said John Stemberger, chairman of Trail Life USA, which bills itself as a Christian alternative to the Boy Scouts.
Trail Life issued its own eight-page legal memo, written by a former BSA lawyer who is now Trail Life’s general counsel.
“The church-chartered troop will likely be sued the moment it tries to revoke the membership of the homosexual member who wears his uniform to the Gay Pride Parade, revokes or denies membership to an adult who publicly gets married to someone of the same sex, or denies membership to the girl who believes she is actually a male,” the Trail Life memo reads.
For its part, the BSA and proponents of the rule change don’t believe this will be a problem because of the way that the memo allowing gay troop leaders was crafted.
Mark Goldfeder, senior fellow at the Center for the Study of Law and Religion at Emory’s law school believes “this is a very decent balancing act and a kind of balancing act that can be a model going forward.”
While I’d like to take Mr. Goldfeder’s opinion as gospel, we conservatives know that such optimistic rhetoric is usually just bluster. Churches, religious organizations and Christian businesses have been sued for far less even in friendlier climates. There is no way that churches that house or support the BSA will be able to avoid litigation if they choose to buck the BSA and continue to ban gay scout leaders. It’s just NOT possible.
Instead conservative BSA troops and the churches who support them should simply leave the BSA and join an alternative scouting group. There are other options and the mass exodus of Christians from the BSA may even cripple the national BSA. Such a move could be an invaluable lesson to other groups considering marginalizing Christians in an effort to placate the fascist gay lobby. Sadly, many Christians will continue to support the BSA and many churches will continue hosting BSA troops… even though they’ve been warned of the gathering storm.
So, churches will get sued and gay rights activists will demand their pound of flesh.
When it happens, and happen it will… I’ll try not to say “I told you so.”
